Different types of Estate Planning to consider

First Party Special Needs Trust

This is created using funds the beneficiary may currently have or soon have. Any remaining funds left after their death must be used to “pay back” the state for whatever Medicaid costs paid on behalf of the beneficiary

Pooled Trust

The Pooled Trust is a variation of the First Party Trust whereby the Trustee is a Special Needs Trust company and manages all the beneficiaries’ monies in a pooled account with each having a sub- account

Third Party Supplemental Needs Trust

Third Party Supplemental Needs Trust is created by a donor who contributes funds to the trust. Upon the beneficiary’s death, the assets remaining in the trust can be passed down to another person of the donor’s choosing.
